All quotations are valid for a period of 60 days from the date of the quotation.
Should a project be commissioned after 60 days We reserve the right to re-quote should We feel necessary.
You shall be responsible for providing Us with the correct specification for each survey / project. We reserve the right to make any necessary changes to quotations should the specification change. Any changes are to be agreed by both parties and confirmed in writing.
Terms and Conditions of Business
The following terms and conditions form the basis of the contract between the client (You) and JES Traffic Ltd (Us / We).
Price and Payment
The price provided in the quotation is the price payable for the survey / project. We require written acceptance of the price before commencement of any work. We also require a valid purchase order prior to the release of any data.
Invoicing to third parties will be considered, however the third party will have to agree in writing to our terms and conditions prior to any work commencing. The contract will remain between Us and You and not the third party.
We reserve the right to charge a fee of £50 to cover administration costs for invoicing to a third party.
By law You must pay any invoice within the agreed terms, 30 days. If payment is still outstanding after the 30 days has expired We reserve the right to charge an administration fee of £40 on invoices below £1000.00 and £70.00 on invoices greater than £1000.00. Interest will also be added at a rate of 8.5% per day.
We also reserve the right to cancel or suspend any contract due to non payment of invoice.
The title to the data supplied to the client will remain the property of JES Traffic until paid for in full.
Cancellation on the part of the client after the contract has been awarded will result in a 25% cancellation fee or incurred costs, whichever is the higher.
Postponement on part of the client after the contract has been awarded will result in the client being liable for any costs which we incurred up to the point of postponement.
Any cancellation or postponement of a survey must be received in writing by the relevant office dealing with the project.
All survey data collected will be released to You only. Unless granted by You no third party will obtain a copy of the data. All information issued by You will be treated as confidential.
Undertaking of Works
It is the responsibility of You the client to check the local area for planned road works or other intrusions which may affect a survey, unless we are specifically asked to do so within your supplied brief.
Should We have to obtain permission for the surveys our fee excludes any cost incurred in obtaining the relevant permissions from the local authorities. You will be notified about any such fees and these will be added to any invoice for the works.
We will not be held responsible for any delay, postponement or cancellation of any works if failure to complete said works is out of our reasonable control. This includes but not limited to strikes, lockouts, riots, civil commotion, acts of God and acts of terrorism, theft, vandalism and war.
Any disputes concerning these terms and conditions have exclusive jurisdiction by the English Courts and are governed by English Law.
